| PROJECT MANAGER FINED FOR UNSAFE WORKING |
A recent
publication by the ECA has highlighted the fact that employees, as well as
employers, can be prosecuted and fined for Health and Safety offences. A
Project Manager has been fined £2,500 and just over £1,000 in costs for an
accident in which a Sub-Contractor suffered severe facial injuries. The
Incident was caused by a Project Manager carrying out an operation using a Fork
Lift Truck, something for which he had never been trained.

| LEGISLATION |
The control of
Asbestos At Work Regulations was introduced in 2002. However, the duty under
regulation 4 does not come into force until May 2004. This duty will require
those responsible for the repair and
maintenance of non-domestic premises to find out about the presence of
Asbestos-containing materials. It also requires a record of location and
condition of Asbestos materials, as well as an assessment and management of any
risk exposure. There is also a requirement to pass on information about the
location and condition of these materials to anyone liable to disturb them.
